Monster Energy Still Suing Toronto Raptors Over Their Logo

Monster Energy has reportedly filed legal documents with the U.S. Patent Office, claiming that the logo the Toronto Raptors is too similar to their own logo. 

According to CBC, the initial suit was put forth in 2015, and the fight is still ongoing, as a judge will ultimately have to decide whether a consumer would likely be confused. Monster’s logo, featuring vertical gashes, resembling those from a claw, has been in use since 2012. The Raptors began using their logo, a basketball with three diagonal claw gashes, in 2014.

According to CBC, the company’s documents reads:

“Monster] will be damaged by registration the Raptors] in that the mark will dilute the distinctive qualities Monster’s] mark … and will lessen the ability Monster’s] mark to distinguish its goods.”

Maple Leaf Sports and Entertainment, which owns the Raptors, issued the following response:

“In one case you have a very popular logo from an NBA franchise that everybody understands is Toronto Raptors. And on the other, you have a logo that everybody understands is Monster Energy. 

“It appears on its face the logos are pretty different.”

Raptors Fan Sends Warriors Flowers Over Kevin Durant Injury Cheers

When Kevin Durant went down with a brutal Achilles injury during Game 5 the NBA Finals on Monday night, the whole NBA world was upset at what had just happened. To add insult to injury, Toronto Raptors fans were accused cheering for Durant’s injury as they realized it gave them a much better chance to win the game. Warriors players were pretty harsh when it came to condemning the Raptors faithful who ended up cheering in favor KD as he walked f the court.

The behavior Raptors fans led to quite a bit debate over the last day or so but some fans are looking to make amends for what happened. One person even sent flowers to the Warriors fices with a nice little message apologizing on behalf those who cheered when Durant went down.

“I hereby apologize on behalf Canada — prayers for recovery,” the letter wrote. “It was a total disgrace.”

The flowers were a nice colorful mix carnations but unfortunately for the Warriors, the nice gesture won’t do anything to help bring Durant back into the lineup. It looks like KD could be gone for up to a year, which means he would miss the entire 2019-2020 season.

Jada Pinkett Smith To Receive "Trailblazer” Award At MTV Movie & TV Awards

Jada Pinkett Smith’s successful career and powerful game-changing moves have come back to reward her since the 47-year-old actress will be rewarded with the “Trailblazer” Award during the 2019 “MTV Movie & TV Awards,” Variety exclusively reveals. Tiffany Haddish will present Jada with the award and previous recipients have been Shailene Woodley, Channing Tatum, Emma Watson and Emma Stone.

“Jada has been a powerhouse since the beginning her career and has achieved multi-hyphenate status throughout,” Amy Doyle, general manager MTV told the publication. “She is the epitome someone who is not afraid to challenge the status quo and we are thrilled to present her with this year’s Trailblazer Award.”

Jada’s Facebook series Red Table Talk has grabbed the hearts many, easily being one the many reasons for Jada’s well-deserved recognition. 

“I did not expect this kind response and this kind success with Red Table Talk, but it’s the one part my career] that I’m most passionate about,” Jada previously stated. “I was looking at this to be more for, like, a hobby. It’s taken the forefront–this is the thing I want to do.”

Why a DJ Khaled 'Monster Lawsuit' Is the Best Thing That Could Happen to Billboard — And the Music Industry at Large

Billboard’s chart rankings are a beautiful mess.  But what’s the solution?

There’s something oddly satisfying about witnessing Tyler, the Creator topping DJ Khaled for the number one ranking on the latest Billboard 200.  Somehow, a trippy exploration of rap’s outer reaches topped a superstar lineup that included Beyonce, Jay-Z, Chris Brown, Chance the Rapper, and Post Malone, among many others.

But as stunning an upset as it appears, DJ Khaled and his merry band of rap superstars probably got robbed.

Everyone’s got a different take on why DJ Khaled’s Father of Asahd ranked second this week — including Billboard itself.   But according to various explanations from Billboard-Hollywood Reporter Media Group, owned by Valence Media, DJ Khaled either forgot to get his specific album bundling idea pre-approved, overhyped the concept he put in place, violated some other obscure Billboard rule, or some combination of all three.

Now, the scuttlebutt — at least according to Page Six — is that Khaled & Co. is planning a ‘monster’ lawsuit against Billboard and its parent, Valence Media (it’s worth noting that Page Six did get its initial coverage on this situation right, or at least part of it. So litigation may be in the works).

The exact damages here are unclear, though perhaps Khaled will argue that by ranking number two, instead of his rightful number one, Billboard lowered his future sales and even live concert revenues.

It’s a bit of a stretch, though an actual lawsuit might be the best thing that happened to the Billboard 200 — and the industry it serves.

But how did we get here?

The issue is that DJ Khaled packaged downloads of Father of Asahd with energy drinks, part of a deal with Shop.com. Tyler, the Creator also bundled his album into merchandise sales, though the difference seems to be that Khaled overhyped his bundled deal to get a number one ranking.

Which means, by logical extension, that if Tyler, the Creator had coordinated a pop-up store stuffed with discounted IGOR paraphernalia, all bundled with his just-released album, he might have been disqualified as well.

Or, maybe not.

Welcome to the brand-new bundling game, one that DJ Khaled apparently played too well (and for a wonderful article about the bundling/charts game, check out this New York Times article by Ben Sisario).

Grandpa, what’s an album?

The bigger problem is that Billboard’s album rankings have now become an inscrutable and arbitrary algorithm.  And it’s all predicated on stuffing any-and-all formats into the once-understandable ‘album.’

Once upon a time, the Billboard 200 counted one thing: actual album sales.  There were limited flavors of said albums, including CDs, vinyl LPs, and cassettes, though once the 90s got going, Billboard and its data sidekick Soundscan were primarily counting $16.98 CDs.

Fast-forward to 2019, of course, and there aren’t any albums left.  Instead, there are ‘equivalent albums,’ with arbitrary totals of paid streams, free streams, and downloads all translating, at some point, into the once-solid ‘album.’

Funny enough, the actual ‘albums’ that are still left, in the form of CDs and vinyl LPs, now carry enormous weight against formats like streams.  But so do ‘equivalent album’ downloads, which is where DJ Khaled got into trouble.

The problem is that the fuzzy math is getting fuzzier, with Billboard suddenly the arbiter of the chaos.

This is now worse than the Grammys, where subjectivity rules and everyone gets shafted.  But despite Billboard’s make-it-up-as-you-go approach, there’s actually a method to Billboard’s madness here.  On one level, the established industry has pressured Billboard to cling to the album, partly because the traditional industry spent so much time itself clinging to the album.

Albums represent the holy grail for any industry: bundling.  Whether a triple-play cable package or a six-pack of Budweiser, bundling is what makes companies and their executives rich.  So it makes sense that old-line labels and execs didn’t want to let the cash cow CD slip away.

But now that the album has mostly been obliterated by market forces, there’s still a fictional album that pervades. And Billboard is clinging to this fiction for a very important reason. Simply stated: the album format itself is still a pervasive cultural and industry concept, one that people can understand.

A billion YouTube streams is a nebulous figure.  Half-a-million streams on Apple Music means something, but what, exactly? By contrast, one million album sales are far more tangible.  ‘Platinum’ makes headlines, it gets people excited, and, in the case of artists like DJ Khaled, leads to top-ranked album chart rankings that satisfy egos and further careers.

It’s a beast that Billboard helped to create, and one that it feeds — every single week.

The album is still tangible, both inside and outside the industry.  And Billboard understands this, even if their execution against this reality isn’t perfect.

Asking Billboard and the industry to ditch the album is like asking Americans to adopt the metric system. Logically it makes sense, but it’ll never happen.

But what can happen is that Billboard can start to create better, more predictable and uniform rules around its Billboard 200 album ranking. And, they can keep clarifying rules to avoid mishaps like this one.

Already, it looks like the specter of a legal mess is prompting more discipline at Billboard.  Things like clearer bundling qualification rules, fewer make-it-up-as-you-go decisions, and better support for borderline questions and situations are desperately needed here.

Litigation sucks, and this is borderline frivolous.  But who knows, maybe an aggressive lawsuit will make Billboard shift its rankings, handing Khaled the top slot after all.  Or, even better, it will force them to better define what an ‘album’ actually is in 2019 and beyond.

At least then, we’ll all be subscribing to the same fiction.

 

Man Who Harassed Lil Xan Reported His Gun Flashing To Police

Los Angeles, CA – The man Lil Xan pulled a gun on at a Los Angeles gas station on Friday (June 7) reported the incident to the Los Angeles Police Department and now the Robbery-Homicide Division has stepped in, TMZ reports.

Authorities are currently investigating the 22-year-old rapper, born Nicholas Diego Leanos, for assault with a deadly weapon — a felony that could carry a four-year sentence.

The incident was caught on camera by the alleged victim and shows the “Betrayed” artist and his fiancée Annie Smith attempting to make him go away, as he incessantly heckles the rapper for calling Tupac’s music “boring.” Xan eventually pulls out what appears to be a firearm and begins waving it around in the alleged victim’s direction.

Later, Xan hopped on his Instagram Story to explain what happened, claiming he felt threatened.

“The media is gonna try and twist what just happened at a gas station,” he wrote. “I was about to be attacked and resorted to having to use self defense. fuck all you old head ass bitches still talking bout that 2pac shit. live your own life and stop picking on a kid.”

Detectives are looking to speak with Xan about the incident to get his side of the story to present their case to the District Attorney’s Office.

Stephen A. Smith Blasts Nick Nurse For Late-Game Timeout: Watch

The Toronto Raptors were just three minutes away from winning their first ever NBA Title on Monday night as they had a 103-97 lead against the Golden State Warriors. That’s when Raptors head coach Nick Nurse decided to call a timeout which had many around the NBA scratching their heads. The Raptors had all the momentum at that point in the game and after the timeout, the Warriors were able to come back and go on a 9-0 run. Of course, the Warriors ended up winning the game by a score 106-105 and Nurse’s timeout immediately became one the scapegoats the game.

Stephen A. Smith went on ESPN’s First Take this morning and lambasted the Raptors head coach for disrupting the team’s flow in the late stages the game. After the match, Nurse said he used the timeout because he didn’t want to lose it, although Smith called BS on that, stating “You were about to win the championship in 3 minutes, okay. And you disrupted it.”

Smith then went on to say that the timeout cost the Raptors the win and a championship on home court. The Raptors will have two more opportunities to win the series including on Thursday night in Game 6 which takes place in Oakland. 

North West Proves To Be Just Like Her Mother In Latest Faux Fur Outfit

We’ve known from time now that North West is becoming just like her mother in the sense that she’s obsessed with anything makeup and fashion related. Most paparazzi spottings the five-year-old show her dressed in cute outfits that we can only assume she had the deciding factor in. The latest photo North sees her once again looking fabulous, this time wearing a fur coat her mother’s that clearly far too big on her.

The image shared to Kim Kardashian‘s Instagram below shows North practically swimming in the white coat with her smiling face peeping through at the top. “Remember when I wore this! She picked out the same look lol but fun fact- I took all my fave furs and remade them in faux fur,” Kim captioned the image. 

“I already know North is into makeup for sure,” Kim previously stated. “She had friends over this weekend and some her girlfriends came and they were just all in her room, giving themselves makeovers. I was like, OK, she’s really, really into makeup. When companies send makeup and I have a lot, I’ll give it to her.”

Chris Brown and Drake Celebrate ‘No Guidance’ Going No. 1

Chris Brown and Drake are celebrating a win together.

The former rivals dropped their highly-anticipated collaboration “No Guidance” on Friday and it didn’t take long for it to hit No. 1 on Apple Music’s Top Songs chart.

Chris posted a screenshot of the Chart Data tweet announcing their No. 1 status. Drake responded in the comments, acknowledging their past beef and revealing that a video is in the works.

“Jeeeeeeez….wait till the video drops,” said Drizzy while joking, “Also are we the first mortal enemy duo to go number one on Apple Music?? #guinessbookofrecords.”

The collaboration has been a long time coming for the former rivals, who had been at odds over their mutual ex-girlfriend Rihanna. They squashed their beef and reunited on stage during Drake’s “Aubrey & the Three Migos Tour” at Staples Center in Los Angeles last October.

Other celebrities responded to Chris’ post. Ludacris called the song “first listen hit type shit,” while Meek suggested a video concept. “Ya’ll should go to war in the video over a baddie … it would be a movieee 🙏🏾🙏🏾🙏🏾🙏🏾🙏🏾 ‘I’m not joking’ 🔥🔥🔥🔥🔥,” he said.

“No Guidance” is set to appear on Chris’ upcoming 9th album Indigo, due June 28, with appearances from Justin Bieber, Nicki Minaj, Lil Wayne, Trey Songz, Tory Lanez, Joyner Lucas, Tyga, Gunna, and more.

Drake Consoles Kevin Durant After Catastrophic Injury: Watch

In his first game back from injury, Kevin Durant appeared to tear his Achilles in Game 5 the NBA Finals between the Golden State Warriors and the Toronto Raptors. The Warriors ended up winning the game although they will be without Durant for the rest the series. It was a sad sight to see regardless which team you’re a fan . One the Raptors superfans who was shaken up over the injury was Drake, who has demonstrated his respect and admiration for KD in the past. 

As Durant left the court and was helped out by his teammates, Drake went up to him and fered some words encouragement. The Raptors crowd was originally criticized for cheering Durant’s injury, although, in pure Canadian fashion, they ended up chanting KD’s name as he walked f the court as a way to apologize for their initial reaction.

After the game, Warriors general manager Bob Myers broke down in tears while talking about Durant’s injury and how the team had done its due diligence before allowing the superstar back into the lineup.

The Raptors currently lead the series 3-2 and will have a chance to win it all on Thursday in Oakland in Game 6.

Ex-NFL Star Brian Banks Faces Another Sexual Assault Accusation

As a high school football star at Long Beach Polytechnic High School in Long Beach, California, Brian Banks was a shoo-in for the NFL. However, in 2002, his classmate named Wanetta Gibson came forward and accused the teenager dragging her into a stairwell before raping her. Banks maintained his innocence but was arrested and charged, and when he learned that he was facing a 41-year jail sentence if convicted, Banks took a plea deal. He was sentenced to five years in prison, five years probation, and he had to register as a sex fender. Gibson and her mother would later sue the school district and won a $1.5 million judgment.

Banks served his sentence and was released, but in 2011 his life changed. His accuser found him on Facebook and messaged him, asking if they could meet up. He agreed to the meeting but would only do so with his attorney present. It was during that conversation that Gibson admitted that she made up the entire rape story, but she wasn’t going to tell prosecutors because she didn’t want to return the money she won in her judgment. What she didn’t know was that Banks was secretly recording their conversation and worked on his own to clear his name.

The football player had his record cleared as he was exonerated by the courts and later went on to sign with the Atlanta Falcons, but last year news surfaced that a woman named Lidija Jovanovic accused Banks sexual assault. According to The Blast, Jovanovic, a maid, states that she was scheduled to clean Banks’ home when he masturbated in front her before fering to pay her for sex back in February 2018. She’s suing him for $10 million.

Banks admits that the two had sex, but he claims it was entirely consensual—and he has the tape to prove it. In court documents, he writes, “I usually explain to people why I have cameras in my home. In 2002, I was falsely accused rape and kidnapping when I was in high school, after a consensual sexual encounter. After pleading no contest to a crime I did not commit and serving six years in prison, I was fully exonerated in May 2012 when my accuser recanted her fabricated claim against me. Thus, contrary to the defamatory allegations in the complaint filed in this proceeding, I am not a ‘former felon.’”

He continues, “After she was done cleaning, Ms. Jovanovic came to sit by me on the couch. I told Ms. Jovanovic that I had cameras in my apartment. In fact, I showed them to her. As a result, she was aware that she was being filmed during the entirety our brief consensual sexual interaction. When she left later that day, she told me, ‘Enjoy your video.’ She also sent me a text message at a later date in which she again told me to enjoy the video.”

“Ms. Jovanovic insinuated that I should pay her for sexual intercourse but I declined and explained that I do not pay women for sex,” Banks says. “I believe she may have been upset that I turned down her suggestion that I pay her for sex.” He paid her $90 for cleaning and says “she seemed disappointed, presumably because I did not pay her additional money for any sex acts.”

Jovanovic reportedly went to the Los Angeles Police Department with claims sexual assault, but they reviewed the footage and refused to pursue charges. That’s when she decided to sue, even though her attorneys have seen the video as well. Banks’s attorney calls the lawsuit “frivolous.” They’ll meet once again in court next month.

Anderson Paak’s Free Nationals Announce Song Featuring Mac Miller & Kali Uchis

Mac Miller‘s posthumous output has been minimal, for all the right reasons. That’s because, leading up to his death, his closest collaborators doubled as his friends. Nobody likes to do wrong by their friends, even for a dollar – even in the music industry. Interchangeability isn’t always what it seems.

It remains implanted in the minds Mac Miller’s closest collaborators, especially in the possession unpublished material bearing his song accreditation. Madlib is a good example the difficult questions that arise when you mix friendship with artistic collaboration. In February it was reported that Madlib was sitting on the suggestively titled “Maclib” demo reels – in a total and utter state ambivalence regarding a prospective release for the project. In good faith, Madlib will come to his sense, one way or another, after doing a little clam digging on the subject.

As for the cache material Mac produced with friend Anderson. Paak, the crux the conversation is quite similar. Little over an hour ago, Paak announced that his band Free Nationals were putting out a single titled “Time” in the coming days; Wednesday the 12th June, to be exact. As you can see in the above cover relic, “Time” will feature contributions from Kali Uchis, Mac Miller, and course, the groups’ bandleader Anderson. Paak. Keep it locked for the drop.

Cardi B Claims Ownership Over Her Lyrics: "I Write A Lot Of My Sh*t"

Not unlike an actual ghost, a reputation for using ghostwriters can haunt a rapper with a frightening degree efficacy. We’ve long seen Champagne Papi plagued by his own set demons, and Cardi B has also been accused taking a backseat during the writing process. Though Drake has largely weathered the storm, many have been quick to use Cardi’s “borrowed” lyricism as a means tearing her down, refusing to acknowledge the possibility she may actually be nice with the pen. As it happens, Cardi took to Twitter to vocalize her displeasure with the narrative, sounding f in retaliation to the mounting claims.

“I do write a lot my shit that’s the thing,” writes Cardi, in a statement from a few days back. “Yes just like every other artist I do have a couple writer that help with hooks but I wrote plenty songs on my album specially my mixtape .Ya just flip shit and ya want to believe the fuck shit so bad but EAT IT UP BITCH!” Clearly, she’s been nursing this one for a minute, and hopes this statement sorts can sway the skeptics in her favor. After all, when Cardi first started buzzing, she was making noise as a “street rapper” sorts, as seen on pre-stardom singles like “Red Barz.”

H.E.R. To Headline Self-Curated "Lights On Festival" With Jhene Aiko, Summer Walker & More

Grammy-winning artist H.E.R. has dropped f quite a nice surprise for her fans since announcing the line-up for Lights On Festival, that she curated herself. The festival will take place on September 14th at the Concord Pavilion in The Bay Area in California.

“Concord Pavilion is the ultimate venue. It is the perfect place to bring people from all over the San Francisco] Bay,” the “Focus” singer said in a statement. “I have many memories watching shows and DREAMING I’d be able to perform there. The Bay Area is my home…..it’s a dream come true to host my festival there.”

Other acts to take the stage are Jhené Aiko, Daniel Caesar, Summer Walker, Ari Lennox, Kiana Ledé, DaniLeigh, Melii, Lucky Daye, Marc E. Bassy, LONR, Tone Stith, bLAck pARty and Rayana Jay.

Drake and Chris Brown flipped the script last week when they decided to forego a traditional Friday release, instead choosing to release their collaborative single on Saturday. The duo had been teasing their summer single for weeks, with many looking forward to hearing it on Indigo when it drops at the end the month. For years, Drizzy and Breezy had not been friends. In fact, they were ten throwing shots at the other in their music and online. They finally made up a few months ago when they reunited on stage and with “No Guidance,” they’ve got a certified smash. Drake even thinks they might be the first “mortal enemy duo” to hit the top spot on Apple Music’s chart.

We’ll see if they end up atop the Billboard list, which has been occupied by Lil Nas X and “Old Town Road” for nine weeks. For now, CB and Drake are satisfied with their No. 1 position on Apple Music. Drake and Breezy may very well be the first “enemy” duo to achieve that feat. Hopefully, somebody is out there that can legitimize the claim. Did Drake and Meek ever hit that spot? Perhaps he’s forgetting all about his former feuds.
